1. Introduction
37x.com (“37x,” “we,” “our”) operates affiliate‐marketing marketplaces populated by product feeds from vetted affiliate networks and suppliers. Our mission is to maintain user trust by ensuring transparency and preventing deceptive or misleading practices. This Misrepresentation Policy sets forth the requirements for all content on 37x domains, including product listings, landing pages, and checkout flows, to avoid user confusion, false endorsement, or hidden relationships.
2. Scope
This policy applies to anything published or displayed on 37x marketplaces, including but not limited to:
Product titles, descriptions, images, and metadata sourced via affiliate feeds
Affiliate landing pages, banners, and promotional elements
Website branding elements (logos, banners, headers)
Affiliate disclosures
Checkout pages (including agentic checkout processes)
User‐generated content (reviews, ratings, comments)
It applies equally to 37x’s internal content editors, affiliate partners, and third‐party service providers who supply or modify listings.
3. Key Definitions
Affiliate Disclosure: A clear, conspicuous statement indicating that a link is an affiliate link, that the 37x marketplace may earn a commission, or that an order may be placed on the user’s behalf.
Supplier Identification: The visible name or logo of the merchant selling the product, as provided in the affiliate feed.
Misrepresentation: Any content that is false, misleading, or likely to cause a reasonable user to form an inaccurate belief about:
Who is selling or fulfilling the product (identity of the supplier)
Your relationship (or lack thereof) with any brand, merchant or supplier
The nature of the transaction (affiliate)
The authenticity or origin of the product
4. General Principles
Full Transparency
Every page, widget, or element that links offsite via an affiliate link or initiates an agentic checkout must contain a clear affiliate disclosure (e.g., “Affiliate Link: We earn a commission if you purchase through this link,” or “We place the order on your behalf with [Supplier Name]”).
No False Endorsement
Affiliates and 37x must not use a third‐party brand’s name, logo, or design elements to imply that 37x or its marketplaces is officially endorsed, sponsored, or affiliated by that brand, unless written permission is obtained.
Accurate Supplier Attribution
Every product listing must prominently display the actual supplier’s name (as it appears in the affiliate feed) and/or logo so users know exactly who is fulfilling the order.
Honest Product Information
Descriptions, images, and specifications must match what the supplier’s feed provides. No exaggeration, outdated data, or unverified claims about the product’s features or availability.
Checkout Transparency
If 37x initiates an agentic checkout, placing an order on the user’s behalf with the supplier, this must be communicated clearly on or before the “Place Order” step (e.g., “Your order will be placed with [Supplier Name]. We do not warehouse products.”).
5. Prohibited Practices
Any of the following constitutes misrepresentation and is not allowed on 37x marketplaces:
5.1. Hidden or Inadequate Affiliate Disclosure
Embedding affiliate links without any visible notice.
Placing disclosure text in tiny fonts or matching font to background color, making it hard for a typical user to notice.
5.2. False or Misleading Branding
Using a brand’s trademark, logo, or design to imply “official” status when no such relationship exists.
Creating domains or subdomains that mimic a brand’s website (e.g., “nike-deals.37x.com”) or using “Official” without authorization.
Incorporating “As Seen On TV,” “Official Brand Site,” or similar language unless verifiably true.
5.3. Misattributing Supplier or Fulfillment
Failing to identify the actual merchant selling the product (e.g., listing “Best Price” without naming “Acme Electronics”).
Indicating that the marketplace is the seller when in fact an affiliate or third-party merchant is.
5.4. Inaccurate or Stale Product Data
Outdated Pricing or Availability:
Displaying a product as “In Stock” when the affiliate feed indicates it is “Out of Stock,” or showing an old price that no longer matches the supplier’s current listing.Unverified Claims or Endorsements:
Introducing statements such as “#1 Best‐Seller” or “Editor’s Choice” without a clear, verifiable source or citation.
To minimize discrepancies, 37x automatically refreshes pricing and stock information on a regular schedule and performs real‐time checks whenever a user loads a product page. Despite these measures, we cannot guarantee absolute accuracy at all times.
5.5. Implicit Endorsement of Suppliers or Brands
Statements or imagery suggesting that a brand or supplier specifically “partners” with 37x suppliers in a way that does not exist (e.g., “Official [brand name] Partner”).
Using supplier‐provided badges (like “Top Seller,” “Premium Merchant”) outside of the context of the affiliate feed if that badge does not genuinely apply.
5.6. Misleading Checkout Descriptions
Not clarifying that the 37x marketplace does not hold inventory and that the final transaction is processed by the supplier or network.
Presenting the checkout page as if the purchase is directly from the 37x marketplace, rather than “through [Supplier Name].”
6. Affiliate & Supplier Responsibilities
Include a Clear Affiliate Disclosure
Disclosures must appear on every page where an affiliate link is present or an agentic checkout can be initiated.
Example language:
“Disclosure: Clicking this link may earn the marketplace a commission from [Supplier Name].”
“We will place your order on your behalf with [Supplier Name].”
Accurately Display Supplier Identity
Use the supplier’s official name or logo, exactly as provided in the affiliate feed (no abbreviations that could confuse consumers).
Do not replace the supplier’s identity with “37x Marketplace” or similar branding.
Maintain Data Integrity
Sync with the affiliate feed at least once every 24 hours to reflect correct pricing, stock, and product details.
Do not “enhance” or “rewrite” supplier copy in a way that changes meaning, omits key details, or adds unverifiable claims.
Prohibit Unauthorized Brand Use
Only display a brand’s logo if it is part of the affiliate feed’s approved asset package.
Obtain express, written permission before using any trademarked artwork (e.g., brand logos, stylized product names) outside of the feed’s standard images.
Automatic product collection pages which present filtered product listings and results for a given supplier or brand are permitted.
Transparent Checkout Flow
Clearly label the final “Buy” button with the supplier’s name (e.g., “Buy from [Supplier Name]”).
Show any relevant supplier policies at checkout (shipping times, returns) and from the product page where possible, rather than hiding them on the supplier’s site alone.
7. Monitoring & Enforcement
7.1. Automated Scanning
Our systems scan every product listing and landing page for:
Missing or hidden affiliate disclosures
Unapproved use of trademarked text or images
Discrepancies between displayed data (price, stock) and the most recent affiliate feed
Listings that trigger a match are flagged for automatic and manual reviews.
7.2. Manual Audits
Periodic spot checks by our Compliance Team focus on:
High‐traffic or fast‐changing categories (e.g., electronics, fashion)
Newly onboarded affiliate suppliers
Any domains or pages shifted over from legacy 37x properties
7.3. Third‐Party Reports
We accept misrepresentation reports from brands, users, or external watchdogs at [email protected].
Include exact URLs, screenshots, and any evidence to support the claim.
7.4. Enforcement Actions
When a violation is confirmed, 37x may take one or more of the following steps:
Immediate Content Removal
Remove or disable any listing, page, or element that misleads users about affiliate relationships, supplier identity, or brand endorsement.
Affiliate Suspension
Temporarily suspend the affiliate supplier and block further content updates until the issue is resolved.
Permanent Termination
For deliberate, repeated, or egregious misrepresentation (e.g., repeated unauthorized logo use, hiding disclosures), terminate the affiliate relationship permanently.
Correction Notices
Post a clear correction or updated disclosure on the affected page(s) if biased content has been live for a significant period.
Notification to Stakeholders
Inform the affiliate supplier of the violation and required remedial steps.
If a brand or user reported the issue, send a follow-up confirming the outcome.
Affiliates have 5 business days from the initial notice to correct a non‐severe issue (e.g., missing disclosure). Failure to comply will trigger suspension.
8. Reporting Misrepresentation & Appeals
8.1. How to Report

The exact 37x marketplace URL(s) where the alleged misrepresentation appears.
A detailed description of the misleading content.

8.2. Appeal Process for Affiliates
If an affiliate receives a misrepresentation notice and believes it to be in error:
Submit an Appeal

Provide a detailed explanation and any evidence demonstrating full compliance (e.g., screenshot of updated disclosure, proof of authorized logo usage).
Review Timeline

Outcome
If the appeal is granted, we reinstate the listing or page immediately.
If denied, the removal or suspension remains in force, and the affiliate must submit a new, compliant listing.
9. Consumer Protections
Refund Assistance
If a user purchased based on misleading content, we facilitate communication between the user and the affiliate supplier for refunds or corrections where we have the data to do so.
Public Correction Notices
For high‐impact misrepresentations (e.g., widespread “Too Good to Be True” pricing), we may post a correction banner on the relevant category page or site banner, outlining the accurate information.
10. Confidentiality & Data Protection
All reports, notices, and appeals are treated as confidential.
Personal data collected during investigations is used solely for enforcement and is secured under GDPR, the UK Data Protection Act 2018, and other applicable privacy laws.
11. Proactive Safeguards & Automated Controls
37x employs a combination of automated systems, standardized frontend templates, and rigorous data‐processing workflows to minimize the risk of misrepresentation on our affiliate marketplaces. These controls include:
Real-Time Data Sync: Backend processes automatically pull and reconcile pricing, stock levels, and product details from affiliate feeds at regular intervals and upon each page load.
Template-Driven Display: Our frontend templates enforce consistent placement of supplier names, affiliate disclosures, and branding elements, ensuring that visitors always see who is selling and how the transaction will be handled.
Content Validation Rules: Automated checks scan for missing disclosures, unauthorized logo usage, or irregular data formats before any listing goes live.
Together, these measures promote clarity and transparency for customers, while substantially reducing the likelihood of outdated, misleading, or incomplete product information.
12. Policy Updates
37x reserves the right to modify this Misrepresentation Policy at any time.
Notification of Changes:
Major revisions will be published on our Help Center and emailed to all active affiliates.
Acceptance:
Continued use of 37x’s services after notification constitutes acceptance of the updated policy.
